1. Agreement to Terms

By accessing our website and using our services, you agree to these Terms & Conditions and our Privacy Policy.

2. Intellectual Property Rights

2.1 Our Content

All content on this website, including landscape designs, photographs, text, graphics, and logos is our property and is protected by intellectual property laws.

2.2 Your Use

You may not:

• Copy or reproduce our designs or content.
• Modify or create derivative works.
• Distribute or publicly display our content.
• Use our designs or content for commercial purposes without permission.

3. Service Terms

3.1 Landscape Design Services

• All designs are custom-created for each client.
• Final designs remain our intellectual property.
• Design revisions must be requested within 2 weeks of the submitted completion of the design to you.
• Site visits and consultations must be scheduled in advance.

3.2 Maintenance Services

• Service schedules are subject to weather conditions.
• Access to the property must be provided as agreed.
• Changes to service requirements must be communicated in writing.
• Emergency services may incur additional charges.

4. Client Responsibilities

You agree to:

• Provide accurate property information.
• Maintain clear communication about project requirements.
• Ensure property access during scheduled services.
• Inform us of any property-specific conditions or restrictions.
• Comply with local regulations regarding landscape modifications.
• Obtain necessary permits when required.

5. Payment Terms

• All prices are in USD.
• Payment schedules will be outlined in service agreements
• We accept Check, Credit & Debit (through Stripe), and ACH transfers (through Go Cardless).
• Design fees are non-refundable once work has commenced.
• Maintenance services are billed monthly.
• Late payments may result in service suspension and accrued late fees.

6. Service Area

• We primarily serve North King and Snohomish counties in Washington State.
• Travel fees may apply outside our primary service area.
• Service availability may vary by location.

7. Cancellation and Rescheduling

• All design consultations must be cancelled 48 hours in advance. Failure to do so will incur a $25 cancellation fee.
• Maintenance services require 72 hours for rescheduling. Failure to do so will incur a $50 rescheduling fee.
• Emergency cancellations are handled on a case-by-case basis.
• Repeated cancellations may result in service termination.

8. Limitation of Liability

We are not liable for:

• Damage caused by weather events or natural disasters.
• Plant failure due to circumstances beyond our control.
• Preexisting property conditions.
• Damage caused by third parties.
• Indirect or consequential damages.

9. Insurance and Licensing

• We maintain professional liability insurance.
• We are licensed to operate in Washington State.
• All work complies with local regulations and codes.

10. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of our services or violation of these terms.

11. Termination

We may terminate or suspend services for violations of these terms or non-payment.

12. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services constitutes acceptance of modified terms.

13. Governing Law

These terms are governed by the laws of Washington State, with venue in North King and Snohomish counties.
